Terms of Service

Welcome to Masterify. These Terms of Service ("Terms") govern your use of the Masterify mobile application (the "App") and related services (together, the "Service") provided by Masterify ("we," "us," or "our"). Please read them carefully.

1. Acceptance of terms

By downloading, installing, or using the App, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

2. License to use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple-branded devices that you own or control, for your personal, non-commercial use. This license is granted in accordance with the Apple Media Services Terms and Conditions (the "Usage Rules").

You may not:

• Copy, modify, adapt, translate, or create derivative works of the App;
• Reverse-engineer, decompile, or disassemble the App, except to the extent permitted by law;
• Rent, lease, lend, sell, redistribute, or sublicense the App; or
• Use the App to violate any law or the rights of any third party.

3. Account and eligibility

The App does not require you to create an account with us. You may need to sign in to iCloud with your Apple ID to use certain features such as cross-device sync. You are responsible for maintaining the security of your Apple ID and device.

Masterify is rated 4+ and suitable for users of all ages. If you are a minor (under the age of majority where you live), your parent or legal guardian should supervise your use of the Service, including any in-app purchases. In-app purchases and subscriptions on Apple's platforms are billed through the Apple ID of the account holder, who is responsible for all charges. We recommend that parents use Apple's Family Sharing and "Ask to Buy" features to manage purchases made by children on family devices.

4. Your content

You may add text passages, reading material, and audio recordings to the App ("Your Content"). You retain all ownership and rights to Your Content.

You are responsible for making sure you have the necessary rights to use, copy, and process Your Content. Do not paste text you do not have the right to use. We do not review or moderate Your Content, and we do not claim any ownership of it.

If you enable iCloud sync, Your Content is stored in your personal iCloud account, not on our servers. If you do not enable iCloud sync, Your Content stays on your device only.

5. Subscriptions and payments

Masterify offers optional in-app purchases and subscriptions that unlock Premium features. All payments are processed by Apple through the App Store, and are governed by the Apple Media Services Terms and Conditions.

Pricing and billing. Prices are displayed in the App at purchase. Subscriptions renew automatically at the end of each billing period unless canceled at least 24 hours before the end of the current period.

Cancellation. You can cancel your subscription anytime by going to your device's Settings → Apple ID → Subscriptions. Cancellation takes effect at the end of the current billing period; you'll continue to have Premium access until then. Deleting the App does not cancel your subscription.

Refunds. All purchase and refund requests are handled by Apple in accordance with Apple's refund policy. We are not able to process refunds directly.

Free trials. If a free trial is offered, it converts automatically to a paid subscription at the end of the trial period unless canceled beforehand.

6. Acceptable use

You agree not to use the Service:

• For any unlawful purpose, or to promote illegal activity;
• To store, transmit, or process material that infringes copyright, trademark, or other intellectual property rights;
• To store, transmit, or process content that is defamatory, harassing, obscene, or otherwise objectionable;
• To attempt to gain unauthorized access to any portion of the Service or its related systems;
• To interfere with or disrupt the integrity or performance of the Service; or
• To reverse-engineer, extract, or reuse any part of the Service outside its intended function.

7. Third-party services

The Service uses third-party components and services to function. Their use is subject to their own terms and privacy policies:

• Apple Speech Recognition — for on-device transcription of your reading and speech practice.
• Apple iCloud / CloudKit — for optional Premium sync.
• Adapty — for subscription management and entitlement verification.
• Firebase (Google) — for content caching and App Check integrity verification.
• Speechify — for Premium AI voice narration (Premium users only).

We are not responsible for the practices of these third parties. See our Privacy Policy for details on what data is processed by whom.

8. Intellectual property

The App, including its design, features, code, brand, and content we create, is owned by us and protected by copyright, trademark, and other laws. Except as expressly permitted by these Terms, you may not use our name, logo, or trademarks without our prior written consent.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free from viruses or other harmful components. Speech recognition accuracy depends on many factors outside our control (background noise, accent, microphone quality, device model) and is not guaranteed.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) US $50.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above may not apply to you.

11. Termination

You may stop using the Service and delete the App at any time. We may suspend or terminate your access to the Service if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination will do so (including intellectual property, disclaimers, and limitations of liability).

12. Changes to these terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top. Material changes will be communicated through the App or by other reasonable means before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of the United States and the state in which the developer resides, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be resolved in the courts located in that jurisdiction, unless mandatory consumer protection laws in your jurisdiction require otherwise.
